· Professional status: CORU Registered Dietitian, Registration No. DI068776
Live Well Nutrition is an Ireland-based online dietetic practice providing services to adults aged 18 and over.
2. Personal data we collect
Depending on how you interact with Live Well Nutrition, we may collect and process:
· Identity and contact information, such as your name, email address, telephone number, address, country of residence and location relevant to online care.
· Booking, appointment, service, purchase and account information.
· Health and clinical information relevant to dietetic care, including medical history, diagnoses or symptoms, medications, supplements, allergies or intolerances, dietary intake, anthropometry, laboratory results, lifestyle, activity and exercise/training information.
· Pre-consultation questionnaires, assessments, consultation records, practitioner observations, goals, recommendations, targets, monitoring information and care-related communications.
· Information you provide through weekly check-ins, food records, messages or other agreed monitoring methods.
· Payment and transaction information. Payment-card details are processed by the payment provider and are not intended to be stored directly by Live Well Nutrition.
· Website, device, cookie and analytics information where applicable and permitted.
· Enquiry and business correspondence.
· Newsletter subscription and marketing preferences where you choose to receive marketing.
3. Why we use personal data
We process personal data where necessary to:
· Respond to enquiries and take steps requested before entering a service contract.
· Administer bookings, appointments, payments, refunds and client accounts.
· Assess suitability, provide, document, monitor and manage dietetic care.
· Communicate with clients about their care and the administration of their service.
· Maintain appropriate clinical and business records.
· Operate, secure and improve the practice, website and technology systems.
· Meet applicable legal, professional, regulatory, insurance, accounting and safeguarding obligations.
· Send optional marketing communications where an appropriate lawful basis applies.
4. Lawful bases for processing
For personal data needed to establish, administer and provide the Live Well Nutrition service, the principal lawful basis is Article 6(1)(b) GDPR: processing necessary for a contract with you or to take steps at your request before entering a contract.
Where processing is necessary to comply with a legal obligation, Article 6(1)(c) GDPR may apply. Other lawful bases may apply to specific activities where appropriate, including consent for optional activities such as certain marketing or non-essential cookies.
Health information is special-category personal data. Where Live Well Nutrition processes health data as necessary for the provision and management of dietetic healthcare, the principal special-category condition is Article 9(2)(h) GDPR, together with the applicable Irish-law basis, including Section 52 of the Data Protection Act 2018.
Consent is therefore not treated as the primary GDPR lawful basis for health-data processing that is necessary to provide dietetic healthcare. Where consent is relied on for a separate optional activity, it may be withdrawn at any time without affecting processing that was lawful before withdrawal.
5. How we obtain information
Information may be:
· Provided directly by you through the website, booking process, questionnaires, consultations, check-ins, monitoring tools, messages, email or other communications.
· Generated by Live Well Nutrition in the course of providing and documenting care.
· Provided by another healthcare professional or third party where you have authorised this or another lawful basis permits it.
· Generated through payment, booking, website-security or technical systems.
· Collected through cookies or similar technologies where applicable and permitted.
6. Clinical records and data minimisation
Nutrium is Live Well Nutrition's primary identifiable clinical record system. Live Well Nutrition aims to keep substantive clinical and health information in the appropriate clinical system and to minimise unnecessary duplication of health information across general business systems.
Google Workspace and other business systems may be used for necessary business communications and administration but are not intended to operate as a parallel clinical-record system. Clients are encouraged not to send unnecessary sensitive health information through ordinary email.
Acuity Scheduling is used for booking and necessary appointment administration. Stripe is used for payment processing. Live Well Nutrition aims to avoid placing unnecessary clinical information in booking or payment descriptions, notes or metadata.
7. Service providers and disclosures
Live Well Nutrition does not sell personal or health information. We use third-party service providers where necessary to operate the practice. Depending on the service and configuration, these include:
· Nutrium / Healthium for clinical practice and client management.
· Squarespace for the website and associated services.
· Acuity Scheduling for appointment scheduling and booking administration.
· Stripe for payment processing.
· Zoom for Initial Consultation video calls.
· Google Workspace for professional email and appropriate business administration.
These providers may process personal data on our behalf as processors in some circumstances and may act as independent or separate controllers for particular activities where applicable to their own services or legal obligations.
Information may also be disclosed where appropriate and lawful to healthcare professionals, professional advisers, insurers, regulators, statutory bodies, law-enforcement or other authorities, or where necessary to protect a person's vital interests or meet professional/safeguarding obligations.
Live Well Nutrition uses service providers only where appropriate contractual and data-protection arrangements are in place or are otherwise required by applicable law.
8. International data transfers
Some technology providers or their subprocessors may process or access personal data outside Ireland or the European Economic Area. Where an international transfer is subject to GDPR transfer restrictions, Live Well Nutrition relies on the safeguards or lawful transfer mechanisms applicable to the relevant provider and service, such as an adequacy decision or approved contractual safeguards where required.
The Privacy Policy and provider arrangements will be kept under review if the technology stack or transfer arrangements change.
9. How long we keep information
Clinical dietetic and nutrition records are retained for the lifetime of the client plus 8 years after death, where the date of death is known. This is the current Live Well Nutrition clinical-record retention policy.
Other records are retained according to their purpose and applicable legal, professional, regulatory, insurance or accounting requirements. Tax and business records follow the applicable Revenue retention requirements and are separate from the clinical-record retention period.
Enquiry and administrative information that does not need to form part of a clinical or statutory record is not kept longer than reasonably necessary for its purpose.
Marketing information is retained while the relevant marketing relationship or permission remains applicable, subject to limited suppression information where needed to ensure an opt-out continues to be respected.
10. Security
Live Well Nutrition uses technical and organisational measures appropriate to the sensitivity of the information handled. These include using dedicated professional systems for clinical information, access controls and account-security measures, and limiting unnecessary duplication of sensitive information.
No online system can be guaranteed to be completely secure. Clients should use reasonable security precautions when accessing online services and should avoid sending unnecessary health information through ordinary email.
11. Online consultations and recordings
Initial online consultations are normally delivered through Zoom. Subsequent consultations may use Nutrium video once client access is established. Consultations are not routinely audio- or video-recorded. If recording were ever proposed for a particular purpose, the privacy, legal and professional requirements would be addressed separately before recording takes place.
12. Marketing
Newsletter and promotional communications are optional. Where consent is required, marketing uses a separate affirmative opt-in. You can unsubscribe or withdraw marketing consent at any time. Stopping marketing does not affect essential clinical, booking, payment or service communications.
13. Cookies and analytics
The Live Well Nutrition website uses cookies or similar technologies as described in the Cookie Policy. Strictly necessary technologies may operate where permitted without consent. Non-essential cookies, including analytics or advertising/tracking technologies where enabled, will require prior consent where required by law.
Website users will be given an appropriate way to manage or withdraw cookie preferences. The Cookie Policy should be read alongside this Privacy Policy.
14. Your data-protection rights
Subject to the conditions and exceptions in data-protection law, you may have rights to:
· Access your personal data.
· Correct inaccurate or incomplete personal data.
· Request erasure in circumstances where the right applies.
· Request restriction of processing in circumstances where the right applies.
· Object to certain processing.
· Receive certain personal data in a portable format where the right applies.
· Withdraw consent where processing relies on consent.
Some rights are not absolute. In particular, a request to erase information does not necessarily require deletion of a clinical record that Live Well Nutrition must or is entitled to retain for professional, legal or regulatory reasons.
To exercise a data-protection right, contact john@livewellnutrition.ie. Live Well Nutrition may need to verify your identity before acting on a request.
15. Complaints about data protection
If you have a concern about how your personal data is handled, you are encouraged to contact Live Well Nutrition at john@livewellnutrition.ie so that the issue can be considered.
You also have the right to lodge a complaint with the Irish Data Protection Commission or, where applicable, another competent supervisory authority.
16. International clients
Live Well Nutrition is based in Ireland. Dietetic services may be available to clients in selected international locations where professional, regulatory, insurance and practical requirements permit. The client's country of residence and physical location at the time care is delivered may be relevant to service eligibility and safe remote care.
The international location of a client does not change Live Well Nutrition's obligation to handle personal data in accordance with the data-protection law applicable to its processing activities, while additional local requirements may also apply in particular circumstances.
17. Changes to this Privacy Policy
This Privacy Policy may be updated where services, technology providers, legal requirements or professional arrangements change. The current version and effective date will be made available through the Live Well Nutrition website.
